• Under 13: Users under 13 may use AskMyNote only with verifiable parental consent and supervision
• Minors (13-17): Must have parental/guardian consent to create an account
• Educational Use: Intended primarily for educational purposes and academic improvement

Capacity to Contract

You represent that you have the legal capacity to enter into these Terms. If you're using AskMyNote on behalf of an educational institution, you represent that you have the authority to bind that institution to these Terms.

AskMyNote Platform

AskMyNote is an AI-powered educational platform that provides:

• Document Analysis: Upload study materials (PDFs, Word docs, text files, images) for AI analysis
• Intelligent Q&A: Ask questions about your documents and receive AI-generated answers
• Quiz Generation: Create custom quizzes from your study materials with various difficulty levels
• Document Summarization: Generate summaries of your content with customizable length and focus areas
• Camera Integration: Capture handwritten questions using your device's camera
• Progress Tracking: Monitor your learning progress and study analytics
• Cloud Storage: Securely store your documents and study history

Educational Purpose

AskMyNote is designed to enhance learning and educational outcomes. Our AI technology helps students:

• Better understand their study materials
• Test their knowledge through generated quizzes
• Review content efficiently with summaries
• Track their learning progress over time

Service Availability

We strive to maintain high availability, but we cannot guarantee uninterrupted service. The Service may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Technical difficulties or server issues
• Third-party service dependencies
• Force majeure events beyond our control

3. User Accounts and Responsibilities

You may NOT use AskMyNote for:

• Completing assignments, exams, or homework without proper disclosure
• Generating content to submit as your original work without attribution
• Circumventing your institution's academic integrity policies
• Cheating on tests, quizzes, or assessments

Illegal or Harmful Activities

• Uploading copyrighted materials you don't have permission to use
• Sharing or distributing copyrighted textbooks or materials
• Processing materials containing personal information of others without consent
• Creating or distributing harmful, offensive, or inappropriate content
• Attempting to reverse engineer or compromise our AI systems

System Abuse

• Attempting to hack, breach, or compromise our security systems
• Using automated tools or bots to access the Service
• Overloading our systems with excessive requests
• Sharing account credentials with others
• Creating multiple accounts to circumvent usage limits

Content Guidelines

When uploading content to AskMyNote:

• Own Your Content: Only upload materials you own or have permission to use
• Respect Privacy: Don't upload documents containing others' personal information
• Educational Focus: Content should be educational in nature
• Appropriate Content: No offensive, harmful, or inappropriate materials
• Legal Compliance: Ensure all content complies with applicable laws

5. Payment Terms and Coin System

Coin-Based Pricing

AskMyNote uses a coin-based system for accessing AI features:

• Coin Costs: Different features cost different amounts of coins based on complexity
• Question Costs: 1-3 coins per question depending on document size
• Quiz Generation: Additional coins based on quiz length and complexity
• Summarization: Coins based on document size and summary detail level

Payment Processing

• Payment Provider: We use Paystack for secure payment processing
• Accepted Methods: Credit cards, debit cards, and other methods supported by Paystack
• Currency: Payments processed in USD or local currency where available
• Billing: Charges are immediate upon coin purchase

Refund Policy

• Unused Coins: Refunds available for unused coins within 30 days of purchase
• Service Issues: Refunds provided if Service is unavailable for extended periods
• Processing: Refunds processed within 5-10 business days
• Partial Refunds: Prorated refunds for partially used coin packages

Free Trial and Promotions

• New users receive 5 free coins to try the Service
• Promotional offers may have specific terms and expiration dates
• Free trial coins cannot be transferred or refunded
• One free trial per user/email address

Copyright Compliance

• Repeat infringers may have their accounts terminated

11. Indemnification

User Indemnification

You agree to indemnify and hold AskMyNote harmless from claims arising from:

12. Termination

Termination by AskMyNote

We may suspend or terminate your account if you:

• Repeatedly upload inappropriate or copyrighted content
• Fail to pay for services when required

Effects of Termination

Upon termination:

• Your access to the Service will be immediately suspended
• Your data will be deleted according to our Privacy Policy
• Unused coins may be refunded at our discretion
• These Terms will continue to apply to past use of the Service

Data Recovery

• You have 30 days after termination to request data export
• After 30 days, data may be permanently deleted
• We recommend exporting important data before account closure
• Some data may be retained for legal compliance purposes

13. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Dispute Resolution Process

For any disputes arising from these Terms or use of AskMyNote:

Step 1: Direct Communication

• We will work in good faith to resolve disputes amicably
• Most issues can be resolved through direct communication

Step 2: Mediation

• If direct communication fails, disputes may be referred to mediation
• Both parties must agree to participate in mediation
• Mediation costs will be shared equally

Step 3: Arbitration

• Unresolved disputes will be settled by binding arbitration
• Arbitration will be conducted under the rules of the American Arbitration Association
• Arbitration will take place in Delaware, United States
• Class action lawsuits are waived in favor of individual arbitration

Exceptions to Arbitration

The following disputes are not subject to arbitration:

14. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AskMyNote regarding your use of the Service.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Assignment

• You may not assign your rights under these Terms without our written consent
